Acceptable use

Store what you like, within the law. This page exists so that the few rules there are, and what happens when they are broken, are written down rather than improvised.

1. Who this applies to

This Policy applies to everyone using Bitnwise Cloud and to all content stored in or shared through an account. It forms part of the agreement between you and the Service, alongside the Terms of Service, the Retention Policy and the Privacy Policy.

You are responsible for everything done through your account, including by anyone you give access to and by anyone who obtains your credentials.

2. What you must not store or share

You may not use the Service to store, process, transmit or make available:

  • Material that is unlawful under European Union law, the law of an EU Member State, or the law of the country you are in.
  • Child sexual abuse material. Any account found holding this is terminated immediately and reported to the competent authorities, with no notice period and no refund.
  • Material that infringes copyright, trade marks or other intellectual property rights you do not hold or are not licensed to use.
  • Material that incites violence, terrorism, or hatred against a group defined by race, religion, ethnicity, nationality, sex, gender identity, sexual orientation or disability.
  • Malware, ransomware, exploit kits, phishing pages, or any other material intended to compromise systems or deceive people into surrendering credentials or money.
  • Another person's private information published without their consent, where the purpose or effect is harassment or intimidation.

3. What you must not do with the Service

  • Public redistribution at scale. Share links are for sending a file to people you choose. Using them to distribute content to an open audience, or embedding them as a content delivery network for a website or application, is not permitted.
  • Reselling. You may not resell your storage, sublicense access, or operate a service on top of your account for third parties. One subscription is one customer.
  • Circumventing the storage limit by spreading one person's data across multiple accounts, or by using accounts registered to people who are not using them.
  • Attacking the Service or the systems it runs on: penetration testing without written permission, denial of service, attempts to access another account, or deliberately degrading performance for others.
  • Automated abuse of the API at a rate that affects other customers. Normal use of the desktop and mobile sync clients is expected and fine.

4. What we do not do

We do not read, index, scan or analyse your files. There is no automated content inspection, no scanning for advertising or profiling purposes, and no training of any model on your data.

This means we generally do not know what you store, and we act on reports and on legal obligations rather than on surveillance. It also means the responsibility for what is in your account is genuinely yours.

5. Reporting a problem

If you believe content stored on Bitnwise Cloud breaches this Policy, write to us through bitnwise.com/contact with the share link or other identifying detail, a description of the problem, how we can reach you, and a statement that the report is accurate to the best of your knowledge. Rights holders should identify the work and the basis of their claim.

We acknowledge reports within two working days. We investigate what we reasonably can without reading unrelated content, and we tell you the outcome.

6. What happens when a rule is broken

Our response is proportionate to what happened. In most cases the first step is to contact you and give you a chance to fix it.

6.1 What suspension means

A suspended account cannot be signed in to. Content is preserved while the matter is open, but is not accessible to you during suspension.

Suspension and termination under this Policy replace the ordinary timeline in section 4 of the Retention Policy. The grace period and read-only stage do not apply, and content may be held for a shorter or a longer period than 100 days depending on the circumstances and on any legal obligation we are under.

6.2 Getting your files back

Where suspension was for a reason that does not prohibit it, and where no legal obligation prevents it, we will provide a reasonable opportunity to export your content before deletion. Ask, and we will arrange it.

6.3 Refunds

No refund is given for a subscription terminated for breach of this Policy. If you are terminated within 14 days of payment and the breach is disputed, the refund terms in section 6 of the Refund Policy and your statutory rights still apply.

7. If you think we got it wrong

Reply to the notice you received, or write through bitnwise.com/contact, and say why. A person reads it, not a system. If we were wrong, we reinstate the account and say so.

We would rather be told we made a mistake than have a customer lose their files to one.

8. Changes to this policy

If we add a restriction, we announce it at least 30 days before it takes effect. Clarifications, corrections and changes that relax a restriction take effect on publication.
